Anon 20.24. This was a clin neg liability finding trial. Given its nature it was all or nothing for the claimant. It sounds as if it’s a very big money case.

There is nothing novel in buying off liability - has no one ever offered a 10% contrib? Not possible here, but it has been done with an offer to discount liability in other cases. It's all in the judgment.

The issue was whether 10% was a genuine offer. On the facts the judge said that it was.

Eminently sensible in my view.
