We need a quid pro quo for this, but sadly the chances of any such in my view are zero.

Probate clients of mine recently received such a letter. Without going into details, when I examined the deceased's assets and means, it became plainly obvious to me that he had not been claiming most of the benefits to which he was entitled.

As I investigated the position, it became clear that he had tried to make claims, but these had been refused, entirely wrongly in my view. Being of a certain age, he also wrongly assumed that he had no right of appeal, and that the decisions must be right.

My suggestion to the Department in response, to the effect that far from pursuing the claim which was being suggested, which incidentally was disputed, the Department should instead entertain a claim for payment to the Estate of all the benefits to which the deceased was plainly entitled but had not claimed, was met with a rather terse response !
