NPCO- Wasted Costs and possible breaches of Principles guidelines laid out by the SRA, awaits those who are trying to peddle unmeritorious cases of dishonest clients- applies to Claimants and Defendants. A lot of Solicitors signed up Claimants to a PRE Jackson CFA/ ATE without carrying out proper due diligence after going through a trawling exercise of their filing cabinets. !!
The Claimants were often dishonest and or without evidence and a lot of those cases maybe discontinued or struck off or lost at trial. The ATE Insurers have repudiated the ATE Policy. The Claimants will often be impecunious with the Defendant holding a substantial cost order against the Claimant. So the Solicitors acting for the Claimant have exposed themselves to a NPCO and better report it immediately to their Indemnity Insurers etc.
We live in interesting times
especially if the Defendant is an LIP and now seeks the NPCO from the the Claimants Solicitors. The ATE Insurers could also be in the firing line in law and the FCA regulations for aiding and abetting? Intended or unintended consequences of a greedy Solicitor?!!!
