How much of the Defence costs are actually Defendant's costs (as a result of QOCS and their inabilty to recover costs even if they are successful and the fact that the NHS and Defence organisations usually use expensive city firms to represent them)?

Why are the Government not taking into account costs which are driven to a disproportionate level as a result of Defendant's conduct? It isn't as if SCIL and others haven't presented the data!
