Speaking with resignation - this was always going to happen, those involved in formulating the rules need to ensure that lessons are learned and not repeated from the experiences of those of us doing PI.
Anecdotally, in fixed cost cases more cases are going to trial (because there's no disincentive on the defendant to take cases all the way) and those that don't are being left by defendants until 2-3 weeks before trial when claimant Part 36 offers are then being accepted. Far more work done than we recover on fixed costs and too few opportunities to escape fixed costs when defendants are cynically delaying in the hope the claimant will just "go away".
I have no problem with cases being defended when they should be but that is not what we're experiencing.
