Perhaps because they don't know what can and can't be claimed for. Gratuitous care, for example. A Smith v Manchester award, for example. Loss of enjoyment of holiday, for example.

Pitting multi billion pound insurers with massive defendant law firms in their pockets on the one side. The man injured on the Clapham omnibus on the other. One side to the dispute knows all about how these things works. The other doesn't have a clue.
