Isn't the lawyer's role generally to advise when and when not to fight - in which case, if the lawyer's judgement is good, so long as the client accepts the advice given, the client should be able to expect to be guided to win more contested battles than are lost?

The article suggests the council lost 100% of cases when advised in-house, and asked its replacement lawyers to call 7 out of 10 that proceed to a final hearing correctly.

If the lawyers had scope to pick and choose which cases were settled and which went to a final hearing, getting the call a bit better than 50/50 doesn't seem an unrealistic target to me
