I agree with Anon at 10:16 yesterday, and it's high time this was introduced.

In a previous post on a related issue, I mentioned a case in which we had no less than 9 Case Management Hearings in the Mags prior to the matter being transferred to Crown Court, all arising from the Crown's failure to deal with disclosure. The attitude of the various Benches and a DJ, was that this is a fact of life with the CPS, that hopefully the issue will be dealt with before we have to come back again, and that no blame can be laid on the Prosecutor that day, who may only have seen the papers (or any electronic record) for he first time that morning.

Nothing will change until sanctions are imposed and begin to bite, and then probably only when Defence Costs Orders as they used to be are reintrodiced and routinely made when this nonsense is perpetuated.
