The police are under a duty, as in it is part of their core function and public duty to protect the public so that if a police officer fails to do so he can be disciplined but under the common law they do not generally owe a duty of care when it comes to the tort of negligence, but that lack of duty which was once referred to as a immunity is being eroded as in the recent Supreme Court case of Robinson v West Yorks Police.
