Perhaps what is needed is just one case where 100% of the costs claimed are awarded - then all could point at it and see just what proportionality looks like. As this never happens (it should be quite common in a truly objective system linked to the reality of cases conducted by regulated professionals) it seems clear that proportionality is just another way of applying the benefit of hindsight; avoiding ever awarding 100% or having a true indemnity principle.
