It doesn't matter which side you are on with ADR the costs are prohibitive. The only winners are the Adjudicators and Legal Profession. You should not be penalised for refusing ADR. Access to the Courts is supposed to be a right and you shouldn't be punished for refusing costly ADR. The Courts need to concentrate on making all concerned accept that if they delay the process by deliberately failing to disclose etc., that the Court will come down heavily on them and the punishment will be harsh. Too many Solicitors still appear to be continuing the old ways of concealment. The expectation of the court re Honesty and full disclosure from the start should be the aim. Not dragging it out for whatever reason. Too many Lawyers not enough interest in integrity.
