What previous commentators seem to be missing is not that a lowering of the standard of proof will mean that the final 2% will be more likely to be "convicted", but that more solicitors will be the subject of disciplinary proceedings once the SRA, and those advising the SRA on the bringing of proceedings, start taking account of a greater ease in securing convictions.
The present standard should be maintained, bearing in mind the potentially massive consequences for solicitors of convictions in financial and career terms. The whole trend against defendants which has been a feature of criminal court proceedings, and other professional disciplinary proceedings, over recent years, should be resisted.
