Can anyone provide a reasoned view as to how fixed costs will remove or reduce fraudulent claims? As i see it, claimants will receive the same as they would have done before so no disincentive. In fact, the possibility exists that, with the introduction of fixed costs and the knowledge by the Travel Industry of an absolute 'cost', tour operators will simply take commercial views and settle more than they are now. This surely will mean more, not less, fraudulent claims slipping through the net. The way to tackle fraud is by tackling fraudsters not limiting solicitors costs. If a matter is suspected of being fraudulent, defendants should run them to trial and seek an FD finding and a referral to the CPS. Fixed costs has no bearing on this mechanism.
