Weirdly enough, things like tort and evidential burdens are present in 100% of whiplash claims. I guess contract law comes in when you're dealing with hire and maybe earnings recovery.

Let's chuck in contrib as to liability and contrib as to causation/quantum too.

Most of these are not arguable in the vast majority of straightforward RTA cases as things are now but a £5k limit for PSLA actually covers significant injuries so they may well be more arguable in the future.

I'm not actually sure what the real reason for the reforms is. It will not promote access to justice. It will not limit whatever fraud there is. It will not benefit society as a whole. It all comes down to large companies saving money.

I guess by your "extremes" and "wholesale abuse" comments that you're very much against claimants bringing claims for injuries. Bully for you.
