The whole waiver thing is misconceived. Waivers are, by their very nature, things which should only happen in exceptional cases and where there is very good reason. These "waivers" go far beyond that: they are moving the goalposts of the whole profession and appear to be favouring bodies which are not regulated law firms at the expense (and to the prejudice) of those which are regulated law firms. That cannot be justified by reference "innovation": it is a misuse of the power to grant waivers and is not consistent with the regulatory objectives contained in the Legal Services Act 2007.

So, when is the Law Society going to start judicially reviewing the granting of these waivers?
