Reporting of the facts was never a problem, it was the sheer triumphalist intensity of it which created the presumption of guilt - the man on the Clapham omnibus would have been entitled to presume the BBC knew something else which established that as a fact, but just felt they couldn't say it out loud, yet. A crass over reaction by the BBC to their own previous shortcomings, IMHOP.
That said, hard cases make bad law, and I don't envy the judge.
