As I understand it, the Brabners case related to what I will call pre-contract searches(local authority search etc), but it seems now, in light of the the Judge's comments at para 62 and 63 of the decision, it will takin in os1s, LR office copies, bankruptcy searches and SIMs, because we use these searches to advise, in the case of purchaser client, that the client can proceed. It does seem that we cannot provide a conveyancing service without doing these LR searches etc., so they cannot be disbursements, and VAT should be added.
