Let's say (for the sake of argument) that the "own costs" of the successful claimants were £1,oo0 per claimant (doubled by the success fee to £2,000) . If, as reported, the claims were for a few hundred pounds each then the successful claimants will be substantially out of pocket. I assume that their solicitors warned them this might happen; if they didn't then it is the solicitor who should bear any shortfall on the successful claims and of course get nothing for the unsuccessful claims. If they did warn them then the claimants ignored that advice at their peril. Let's face it, the claimants were jumping on the gravy train for a huge risk and little to gain for the claimants; that is called gambling in my book. I wonder who encouraged them to do that?
