It would seem I am the only person to disagree.
Smith wanted to be self employed. He took up an offer of work which had conditions attached. He now wants to change those conditions but his requirements do not fit in with his "employers" requirements. He has now been granted rights which were not in contemplation of the "employers" when they agreed to accept him
The decision is going to cause problems in the profession.
Those who draw this type of "contract" for a client/employer or advise on a "contract" on behalf of a prospective "employee" will now have to be extremely careful they do a job which is perfect as, otherwise, they might be held liable for any damages ordered to be paid by the "employer" or failure to obtain what he wants by the "employee"
History has repeatedly shown that this kind of decision can breed off-shoots faster and more numerous that any plant in the garden.
