Note to writer: as was pointed out by another commentator to the Gazette first article by the same writer. The following remains incorrect and adds to public confusion on employee status versus worker versus self-employed. Mr Smith isn't able to pursue an unfair dismissal claim. The ET found he was not an employee and that wasn't appealed. Only employees can claim unfair dismissal. As a worker, he might however be able to claim equivalent compensation. We know he's claiming direct disability discrimination (a discriminatory dismissal presumably) and complains his contract was terminated due to asking for reduced hours after a heart attack. But it's not an unfair dismissal claim and involves different considerations.
