This is one of those matters where I feel an initial knee jerk reaction to defend a fellow litigator in a difficult position juggling coming off record and potentially leaving a client with a costs bill or settling on best terms. Then I read the judgment and all sympathy falls away.

Who on earth would think issuing court proceedings without instructions is a good idea? What if D doesn't back down?
