The figure of £750m does not tally with the figure of £550m given by the MoJ in its written submissions to the CJEU nor with the figure given orally by the MoJ's counsel to that Court. The latter, which was not easy to hear and interpret, appeared to be lower again and may have included claims which were already statute barred. Whatever the figure, apart from arrears (or compensation of a like amount) which have been accumulating since 2000, the sums will only be payable to those appointed before 2000 and retired after that date and whose claims are not statute barred. Even then the additional pension amounts will only be in periodical amounts between retirement and death. So far as I am aware, I am the only part time judge who retired between 2000 and 2006 whose claim is not statute barred.
