How many cases are dropped before trial off the back of an Section 57 defence? I have personally dropped over 10 litigated files in the last 2 years and accepted substantially reduced settlements on countless more with S57 looming over the claimant.

Horwich Farrelly May have only succeeded out and out on a handful, but overall, s57 works exceptionally well in my experience. Particularly with low speed impact cases, it pretty much kills them dead.

Of course the downside is that often genuine cases that have been the victim of a substandard Medco report may have to be settled for substantially less due to the weight of a S57 defence.
