I would disagree with Anon 8:39. It was far from hopeless.

The fee and statement of value should be correct when a claim is issued. If amendment is required, good reason should be given when an application to vary is made in order for variance to be granted.

The clear intention here, not to accept settlement at the very top end of the statement of value, cannot be seen as anything other than a deliberate attempt to flout the rules by paying a lower fee.

As a claimant lawyer, I feel that the Defendant should have succeeded here. Claimant should not be allowed to act with impunity like this. Where is the sanction to dissuade others?
