This isn't a pendulum swing really. The Court won't be ordering indemnity costs in every case where a Part 36 is accepted late, there has to be certain conduct issues and accepting late is not a conduct issue in itself, the Defendant is usually penalised for late acceptance by having to pay further costs they would otherwise have avoided.
