Finding a balance is indeed the key, however note the losses as opposed to recovery likely. If the Civil Liability Act comes in as proposed, then this will be small fry compared to the effect of that. Wherever you stand on this issue, you cannot deny that a lot of business will either shrink massively or go under and creditors of a large variety and scope will be significantly out of pocket and quickly (not least the courts and fees). Any change therefore must be closely managed to ensure we don't have a large scale version of this.
