Schemes, emails and conversation between people aimed at conspiring to select someone for redundancy, or other capricious treatment because it is awkward to deal with their disability, gender preference, their face does not fit with the managers and so on is dishonest and not a matter that ought properly to be the subject of privilege. It is dishonest and anything that helps to make it more difficult to get away with this kind of ganging up on the odd one out is a good thing. Employers have been doing it for years. Ironically, these types of manager often have little vested interested in the underlying success of the business because they end up getting rid of better lawyers and keeping inferior ones for an easy life.
