Anon @ 16:25 on 30/08/2019. Please read the rules in particular CPR 25.13. ABC is a litigant in person and anyone else bringing a claim as an individual is generally not affected by CPR 25.12 as by and large the provision is meant for a company or other body. The Claimant in this case may have failed to give his address in the claim form so an order could have been obtained but your average Claimant as an individual, correctly serving a claim form, would not have such an order made against them.

Simply being unable to pay a Defendant's costs in the event of a loss is just not a good enough reason for an unscrupulous defendant to avoid the consequences of their actions, although you would have us believe so.
