Some Defendant insurance companies and their solicitors have started to routinely threaten Claimants with costs orders if they lose notwithstanding QUOCS on the basis that if a claim fails it will be because it is fundamentally dishonest. Other Defendant Insurance companies are writing direct to clients asking them stupid questions about how they found their solicitor, or why they have taken 6 months to bring a claim or whether they have been subjected to marketing pressure in bringing a claim when they have solicitors instructed. That is what is happening .. but all we hear about is alleged bad practice by Claimants. Let it not be forgotten which industry made the most out of referral fees in the first place with their "Legal Family Protection" insurance policies or whatever and frankly I find it odd that there are insurers out there still referring their insured to "panel solicitors" when they wish to make a claim - how does that business model play out financially?
