I recommend people actually read the judgment (paras 26 and 27 in particular) - she wasn't entitled to claim the bereavement payment as the co-habiting relationship wasn't analogous to a marriage. She was only allowed to claim the widowed parent's allowance because the children's situation was the same whether the parents were married or not. All the judges felt that the fact that she could not claim the bereavement payment was correct and that point wasn't even under appeal. On that basis it's only widowed parents that would be able to claim the WPA for the benefit of the children - cohabitees without children would still fall foul of the first hurdle
