In terms of the Government's amendment to apparently audit the promise of insurers to their princely £35 promise then, leaving aside the issue as to whether or not it would be an effective measure generally, it only suggests regulations to compel insurers to provide data as to the difference in the level of damages paid out under the Act not the difference in the level of costs paid out. It will therefore inevitably undervalue the true savings which insurers will make if the Bill becomes law in its current form.
