Andrew your naivety is endearing. We lawyers appear in these Courts regularly and if we challenge the legal adviser, they will have it in for us the next time. Rarely have I found an even handed fair clerk that ran a straight game. I suspect you are a Magistrate so start the ball rolling by refusing to allow the clerk into your retiring room and insisting that any advice is given in Court. Lets see how long you last?
