Mr Beach was probably quite lucky to have got off as lightly as he did. Getting a second doctor to informally confirm capacity just 4 days before his client's death when a formally instructed doctor had decided that the client was confused and did not have capacity cannot be right in circumstances where the main purpose of the will is to gift a property worth £478,500 to the solicitor! If you do not know, or follow the rules, you should not be drafting wills. No wonder he also ended up in litigation with the other beneficiaries.
