There was an argument of some merit to suggest that referral fees resulted in poor quality claims and fraudulent claims where the cause was a road traffic collision.

This argument loses the limited merit it had when against RTA's when applied to clin neg.

One only has to read the reports of the enormous settlements reported yesterday in the Guardian and the comments of regarding the approach to defending the claims to see the approach all too often taken by the NHSLA.

I have never met a victim of clin neg who saw the recovery of damages as a 'windfall' all would rather not to have suffered the adverse / untoward outcome.
