Whether the client is legally aided or no, the Family Courts are in an appalling state. As someone who is a lawyer (not family) and currently going through a divorce, I think someone might have a thought for the actual people going through the process, agreed financial consent order - delayed due to a 'backlog', once received, decree absolute - delayed due to a 'backlog', meanwhile I am living in a house I cannot afford alone, still paying for the car he is using etc. If I am stressed, then I am going to take it out on my poor solicitor as I lose money hand over fist as property prices drop and I am still paying the bills. The system as it stands is not fit for either the legally aided or the slightly more affluent who have an income and therefore cannot apply for legal aid but who are nevertheless struggling with the financial and emotional fallout of divorce.
