I do appreciate the complex legal issues involved in this case and I respect them but I’m going to go out on a limb here and say that this is a case which should never have gone to Court.

I understand the business owner’s reasoning and understand why this reasoning might cause some offence. However, is there not a right to express that reasoning ? Or should they have just said “We’re not making your cake Mr Lee as we’ve run out of sponge and we’re not expecting a delivery in until April 2024” - this would have avoided litigation but it's not an honest reason and surely the business owner is entitled to provide an honest reason and the customer can take to Trip Advisor if unhappy about that reasoning.

No doubt Mr Lee’s solicitor is content that his pursuit albeit unsuccessful in the end was worthwhile as there was an important principle at stake. From that perspective it is an admiral course of action but commercially, in view of the amount of time and cost which was expended, Mr Lee might have been better advised to find another cake shop or make his own cake.
