Who will be obliged to point out the more complex injuries within a medical report? Jo public may not necessarily understand the contents of a medico-legal report, the 18 year old at the insurer is only interested in settling as many as s/he can. In the event of negligence, where is the recourse? Its not the Medico-legal expert's problem and the insurer will simply say "your fault Jo, you signed to accept our offer".

Insurers will not point the issues in the report to the Claimant, nor should they. They routinely try to under settle MT claims as it is, with legally represented Claimants. When there is no lawyer what will happen?

Also, every seems to assume that the laymen knows what injury is worth over £5K. Many won't. They may just assume this LIP portal is the only way - straight into the jaws of the insurer.....

Before insurer man pipes up about untrained paralegals at claimant firms clicking buttons... In all firms they are trained to spot glaringly obvious things in medical reports so its rare that errors are made. Of course, when they are, the claimant can sue his solicitor.
