I don't understand how one can discuss issues like this without looking at (i) the inequality of arms between the SRA and the respondent solicitor, (ii) whether the respondent solicitor has insurance which covers him/her against the costs of defending disciplinary proceedings and (iii) the SRA's "Walking the Line" paper.

The piece assumes that the SRA is subject to the same ethical code as solicitors. That is not correct, whether in law or in practice. The reality is that the SRA is quite happy to hold solicitors to standards which it does not adhere to itself; and there is no tribunal which holds the SRA to account for breaching any ethical standards which may apply to it.

Having spent £7.5million seeing off the SRA, Leigh Day will be well aware of these facts.
