This is not a fair development. Let's hope a judicial review is brought (see useful points at 10:17).
And @ 9.29 "It costs no more to grant probate to a rich estate than it does to a poor one and - subject if you like to a zero rate for the very smallest estates - there shoud be a flat fee to cover that cost and no more." As a solicitor whose only experience of probate is struggling to find good value solicitors for my own simple will and for family members, if only the profession would bear this in mind, abolish (the far more expensive than these probate proposals) percentage legal fees (often 2% of the estate value irrespective of complexity and time required and sometimes an hourly rate on top!) A material part of which is administrative work carried out by trainees. If someone needs an executor and there's no appropriate family member, I'd always recommend a solicitor rather than unqualified competitors but the profession often has a value-cost disconnect which drives people elsewhere in many practice areas. Not helped by a lack of price transparency.
