I worked in probate as a partner in a small country practice - I watched as estate agents grew their income from 1970 by charging a % of the sale price and refused to negotiate it away. At the same time solicitors were forced to stop charging a % of the price in conveyancing which resulted in the flood of claims everytime that the market declined - find the solicitor who never warned about 100% mortgages etc. On probate we did charge a 1/2% of the value of an estate plus time cost but this was being negotiated away by executors/beneficiaries who would not pay the percentage. Even stock brokers still charge a % for foreign & telephone transactions and Banks the same for arranging a mortgage? Interesting that now legal fees are generally charged on a time basis there is a mood to revert to a fixed scale for lawyers in many matters, so perhaps the fee scale has gone full circle?
