The adversarial system is fantastic when all parties have professional adversaries. It doesn't work so well when you have one represented party and one LiP. This imbalance can never hope to be rectified by the Bench without the represented party feeling hard done by.

A clumsy analogy: A Michelin-starred chef enters a cooking competition alongside 18 year old Darren, who has never been in a kitchen in his life, and who has decided to submit a plate of beans on toast. There can be only one outcome, unless of course the judges bend the rules, thus leaving the Michelin chef with a burning sense of injustice, and the credibility of the competition as a whole completely undermined.
