Did he need to be struck off? Ummmm ..... Yes, he did. He cocked up by failing to cancel the expert witness. Instead of swallowing the loss himself, or attempting to justify the disbursement to the client, he put the witness in the position of having to sue him for his money. If he believed that his client was going to be ultimately liable, which seems debatable at least, he had a clear duty to inform her of the state of play. How would you feel as a client? "Your case has been settled out of court, unfortunately our expert witness is now suing you instead, our costs for continuing to represent you are likely to be in the region of ...." - when it was the solicitor's error in the first place.
Of course one can sympathise with someone rashly throwing their career away, but come on, did he need striking off? Absolutely.
