Quite, their lack of knowledge and ability to understand how to conduct an investigation is staggering.

We had a complaint about failures in some conveyancing matters going back to the early 00's.

We looked and could see no record that we ever acted in those matters (we could see an unrelated matter for the same person) but the file had been destroyed.

We told the complainant we couldn't respond to his complaints because we did not think that he was our client and in any event we had no papers.

The Onbudsman opened an investigation and asked us to provide evidence. When we set out the above they said that if we failed to co-operate they would make a finding against us and refer us to the SRA.

Eventually we said, well get papers from the complainant showing that we acted, that his complaints have merits and we can respond.

The complainant could not produce the docs and eventually they closed the file.

Now wouldn't it have been reasonable to require the complainant to provide some documents before undertaking the above?
