You appear to have overlooked that costs will not recoverable either in or out of the portal for claims under £5k as costs will be linked to damages recovered. So it can stay in or drop out of the portal, it doesn't matter - there will be no costs to pay if it settles for under £5k.(other than small claim fixed costs).

So the only thing to do is take half from the client, and if a 3 month whippy gets a claimant £300, you get £150. Try making a successful business on that when current portal costs mean firms barely make profit as it is.

As for enforcement for non-payment after an hours' default, no court in the land will be willing to consider that type of aggressive conduct without imparting serious cost consequences on the applicant.
