What were the £400,000 costs for? The costs of the entire action or just arguing the bias issue? Surely the claimant's representatives must have advised their client that their claim was useless. Just because lawyers know and respect each other, enough to recommend them for career progression even, doesn't mean there is a conflict of interests or that they are unable to focus on the merits of the case in hand. In fact it's co-operation and mutual respect between lawyers that helps get things resolved in litigation.
