Politics apart, it is arguable that these charges are effectively a potential third tax on the deceased - they bought the assets comprising their estate out of taxed income, inheritance tax may have been payable on their estate and now these charges have been criticised as being in the nature of a tax, for which primary legislation should have been tabled. As one commentator has said on another Gazette report, there may be potential for judicial review.
