I suppose that Withers can take comfort from the fact that in the inevitable negligence claim against them they can refer to the conclusion reached by Mostyn J. and argue that there was no consequential loss as the chance lost was valueless. However that comfort may not be available to other law firms who have refrained from the issue of proceedings in reliance upon stand-still agreements. Supreme Court here we come!
