It would certainly be possible to simplify the process of divorce itself so that more of those concerned could manage it without help. The process should be administrative; the Registrar of Births, Marriages, Deaths and Divorces could do it. If in any case it seemed that there might not be jurisdiction the Registrar could refer it to the court and the applicant would have to litigate or not divorce; but that would be highly exceptional. Now that pension sharing is in force no defence based on grave financial hardship can arise, and as for grave other hardship, what is that? If you don't believe in divorce and don't want to remarry, fine, don't remarry.

It's when people choose or are forced to act in person over money and children that the road gets rocky. And don't get me started on one party being given legal aid because she, usually she, alleges that the other has been violent while he, usually he, is refused legal aid although he denies it. Article 6, anybody?
