I find it odd that solicitors (all anonymous of course) have a problem with clients paying up to 25% for their legal fees in a litigation matter.

How many non PI litigants get away without paying at least that much in solicitor own client fees?

And without having to pay a penny until the end of the case?

And not paying at all if they lose?

How many litigants have the protection of not having to pay disbursements if they lose or protecting their damages if they don't beat a part 36 offer at trial?

ATE is the only way solicitors who fund the disbursements and take the part 36 risk for the client can at least get their outlay back if the client loses or doesn't beat an offer.

I agree that solicitors should make sure the ATE is appropriate and that the premium is reasonable, but how many of you non PI lawyers would contemplate funding a case to its conclusion with no hope of getting your disbursements back? Anyone??
