Just because Zelda Perkins has received independent legal advice does not mean that she has followed it. There is no requirement to follow advice in a settlement agreement, merely to obtain it. The size of the payoff may have outweighed the correct legal advice in her mind and so she decided to take the money. There need have been no complicity, negligence or bad faith on her solicitor's part, unless anybody now thinks that it's a criminal offence not to heed the advice of your solicitor.
